Rub R Dek® Limited Warranty

Rub R Dek® warranty applies only to Do-It-Yourself customers of Rubber Depot Limited. Rubber Depot shall warranty Rub R Dek® against defective materials for a period of 5 years from the original purchase date so long as the original purchaser continues to maintain ownership of the surfacing, can provide an original proof of purchase, and demonstrates that the application was carried in accordance with Rub R Dek® installations procedures.

Rubber Depot will, at its option, refund the customer the purchase price, or supply materials required to re-surface the defective area.

Rub R Dek® warranty will not apply if the following procedures and conditions are not followed:

• Instructions and installation procedures supplied by the Rubber Depot must be strictly followed.
• The existing base must be properly prepared, cleaned and free of all loose debris. The existing base must be untreated, and uncoated to ensure a proper adhesion.
• Rub R Dek® is not warranted against cracking due to excessive ground movement.
• Rub R Dek® is not warranted against damage caused from fire, hurricane, tornados or deterioration of the original sub base construction materials.

Since the manner and condition of application are beyond our control, Rubber Depot shall not be liable for any injury, loss or damage, direct or consequential arising out of the use or the inability to use Rub R Dek®. The buyer’s sole and exclusive remedy against the Rubber Depot shall be the replacement of the defective product, and no other remedy (including, but not limited to, incidental or consequential damages for lost profits, lost sales, injury to property, labor costs and expenses or any other incidental or consequential loss) shall be available to the buyer.

Damage resulting from shipping and handling is not considered a product defect and any claims should be made directly with the carrier.
